By downloading, installing, or using Noctium ("the app"), developed by Obelisk Agency, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the app.
1. Acceptance of Terms
By accessing and using this app, you accept and agree to be bound by these Terms and Conditions and our Privacy Policy. We reserve the right to modify these terms at any time, and your continued use of the app constitutes acceptance of any changes.
You must be at least 13 years old to use Noctium. The app is not directed at children under 13, and we do not knowingly collect information from them.
2. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal purposes. This license is subject to the following restrictions:
- You may not reverse engineer, decompile, or disassemble the app, except to the extent such restriction is prohibited by applicable law
- You may not use automated systems or software to extract data from the app
- You may not transfer, rent, lease, or sublicense the app to any third party
- You may not use the app for any illegal, fraudulent, or unauthorized purpose
- You may not remove or alter any proprietary notices in the app
3. App Functionality
Noctium is an ebook and audiobook reader that allows you to:
- Import and read ebooks in various formats (EPUB, PDF, CBZ, FB2, MOBI, TXT, Markdown, DOCX, HTML, and RTF)
- Read books in place from a folder you choose on your device, without copying them into the app
- Import and listen to audiobooks
- Browse and download free public domain content from Project Gutenberg and LibriVox
- Connect to self-hosted content servers (Calibre-Web, Kavita, Audiobookshelf)
- Back up reading progress and preferences to Google Drive
- Track reading statistics and set reading goals
4. User Content and Self-Hosted Servers
You are solely responsible for the content you import into the app and for any servers you connect to. We do not host, verify, or endorse any content accessed through self-hosted server connections. You must ensure you have the legal right to access and use any content you import or download through third-party servers.
5. Public Domain Content
The app provides access to public domain content through Project Gutenberg and LibriVox. These are independent services not affiliated with Obelisk Agency. We do not guarantee the availability, accuracy, or completeness of content from these sources.
6. Disclaimer of Warranties
The app is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that:
— The app will be error-free or uninterrupted
— Content from third-party sources will be accurate or complete
— The app will be compatible with all devices or configurations
— Self-hosted server connections will function with all server versions
You use the app at your own risk.
7. Limitation of Liability
To the maximum extent permitted by law, Obelisk Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the app, including but not limited to:
- Loss of data, reading progress, or content
- Interruption of reading or listening sessions
- Issues with self-hosted server connections
- Inaccurate metadata from third-party sources
8. In-App Purchases
The app offers a one-time "Remove Ads" purchase through Google Play Billing. All purchases are processed by Google Play and are subject to Google Play's Terms of Service. Refund requests should be directed to Google Play support.
9. Advertisements
The free version of the app displays advertisements provided by Google AdMob. Ads are not shown on reading or audiobook playback screens. Ad display complies with Google's advertising policies. You may remove advertisements by purchasing the premium version.
10. Third-Party Services
The app integrates with third-party services (Google Drive, Google AdMob, Google Play Billing, Firebase, Project Gutenberg, LibriVox, Open Library, Google Books, the iTunes Search API, Wikipedia, the Free Dictionary API, and KOReader-compatible progress sync). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.
11. Intellectual Property
The app, including its design, code, graphics, and branding, is the intellectual property of Obelisk Agency. Public domain content accessed through the app remains in the public domain. Open-source components used in the app are subject to their respective licenses, viewable within the app's About screen.
12. Termination
We reserve the right to terminate or suspend access to the app at any time, without prior notice, for conduct that violates these Terms or is harmful to other users or third parties.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the app after changes constitutes acceptance of the modified terms.
14. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.
